USPTO Announces AI Strategy to Empower Responsible Innovation

The U.S. Patent and Trademark Office (USPTO) has released a new Artificial Intelligence (AI) Strategy, outlining its approach to navigating the rapidly evolving landscape of AI technologies.

As Acting Under Secretary of Commerce for Intellectual Property and Acting Director of the USPTO, Derrick Brent, emphasized, "We have a responsibility to promote, empower, and protect innovation." The strategy aims to fulfil this responsibility by guiding the agency's efforts toward realizing the potential of AI within USPTO operations and across the intellectual property (IP) ecosystem.

This move comes as the use of AI continues to increase rapidly, prompting growing scrutiny over its ethical implications and societal impact.

At the centre of the strategy are five key pillars:

  • Fostering Responsible Innovation: The USPTO aims to develop Intellectual Property (IP) policies that encourage responsible and inclusive AI innovation while addressing potential challenges, such as bias and discrimination.
  • Building Internal AI Expertise: The agency plans to invest in advanced computational resources, data infrastructure, and AI-powered tools to modernize its operations and improve service delivery.
  • Prioritizing Responsible AI Use: The strategy emphasizes the importance of responsible AI use both within the USPTO and across the broader innovation ecosystem. This includes a commitment to transparency, accountability, and fairness in the development and deployment of AI systems.
  • Developing an AI-Savvy Workforce: The USPTO will invest in training and development programs to equip its workforce with the necessary skills to understand and navigate the complexities of AI.
  • Fostering International Collaboration: The agency will collaborate with other government agencies, international partners, and the public to address shared AI priorities and ensure global cooperation in this critical area.

A Landscape of Diverse Opinions

The USPTO has actively engaged with stakeholders through its AI and Emerging Technology (ET) Partnership, gathering input from a diverse range of voices, including researchers, industry leaders, and civil society organizations.

While many welcome the USPTO's efforts to embrace AI and shape its development, concerns remain. Critics have raised concerns about potential biases in AI systems, the ethical implications of AI-driven decision-making, and the need for robust safeguards to protect individual rights and privacy.
